3. Toorunstyle’s Response to DMCA Notices
Upon receipt of a valid and complete DMCA notice, Toorunstyle’s policy is to:
- Remove or disable access to the allegedly infringing material.
- Notify the content provider, member, or user who posted the material that we have removed or disabled access to the material.
- Take reasonable steps to promptly notify the content provider, member, or user that we have removed or disabled the material.
4. Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a “Counter-Notification” to our Copyright Agent by email. Your Counter-Notification must include:
- A. Physical or Electronic Signature: A physical or electronic signature of the subscriber.
- B. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- C. Sworn Statement: A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- D. Contact Information: The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
Upon receipt of a valid Counter-Notification, Toorunstyle may send a copy of the Counter-Notification to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored within 10 to 14 business days or more after receipt of the Counter-Notification, at our sole discretion.
5. Repeat Infringers
Toorunstyle may, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers.
